Terms of Service

These Terms of Service ("Terms") govern your use of the website at livingsoillab.bio (the "Site") and the soil-analysis services described on it (the "Service"), each operated by EarthOptics, Inc. ("Company," "we," "us," or "our"), a Delaware corporation with its principal place of business at 800 N Washington Ave, Suite 702, Minneapolis, MN 55401. By accessing the Site, placing an order, or using the Service you agree to these Terms. If you do not agree, do not use the Site or the Service.


1. Who we are and how to reach us

EarthOptics, Inc. operates the Site and Service. "Living Soil Lab" is a trade name of EarthOptics, Inc., the soil-insights company.

2. What you're buying

The Service is a mail-in soil analysis. We offer one or more soil-analysis products; the specific tests available, what each covers, and their prices are described on the Site at the time you order.

No physical kit ships to you. After you order, you receive a prepaid mailing label and a sampling guide. You collect a soil sample using common household items (for example, a clean trowel and a zip-top bag) and mail it to our partner laboratory. You then receive an online digital report with interpretation guidance for the analyses you purchased. We may add, remove, or change the products, analyses, and prices we offer at any time; the terms and price that apply to your order are those in effect when you place it.

3. Orders, charges, and pricing

Pricing. All prices are in U.S. dollars and are shown on the Site. The price displayed at checkout is the price that applies to your order. We may change prices, run promotions, or offer discounts at any time; changes do not affect orders already placed.

Authorization and charge. When you complete checkout, your payment method is charged the full purchase price at the time of order. Sales tax, if applicable in your state, is calculated and added at checkout.

Turnaround. After the laboratory receives your sample, your report is typically delivered within about two weeks, by email and online access. Turnaround times are estimates, not guarantees.

4. Cancellation and refunds

60-day money-back guarantee. If your report is not useful to you for any reason, request a refund by emailing support@livingsoillab.bio within sixty (60) days of report delivery. We will refund the full amount you were charged to your original payment method, typically within 5–10 business days of receipt of your request. No questions asked. You may keep the report.

Cancel before your sample is analyzed, for a full refund. If you have not yet mailed your sample, or it has not yet been analyzed, email support@livingsoillab.bio from the email address used at checkout and we will refund the full amount you were charged, typically within 5–10 business days.

Problems on our end. If we determine your sample cannot be analyzed due to a problem on our end, we will contact you and either arrange for you to submit a new sample at no additional charge or refund you, at your election.

If we cannot fulfill your order, we will notify you and refund you in full. You do not need to take any action to receive a refund in that case.

5. Sample submission and acceptable use

By submitting a soil sample, you represent that the sample was collected from a property:

The Service is intended for personal, non-commercial soil-analysis purposes. You may not resubmit, resell, or republish your report for commercial soil-advisory or regulatory-compliance purposes.

We may decline to analyze a sample that arrives damaged, contaminated, or in a form inconsistent with the sampling guide. If we decline a sample for these reasons, we will email you and either arrange for you to submit a new sample at no additional charge or refund you, at your election.

6. Geographic scope

We accept soil samples collected within the contiguous 48 U.S. states and the District of Columbia only. We do not accept samples originating from Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, Guam, or any other U.S. territory. Orders placed for samples from ineligible or quarantined areas will be canceled and refunded.

7. The report is informational

The digital report and any recommendations included with it are educational and informational. They are not a substitute for site-specific professional agronomic, horticultural, environmental, or regulatory advice. You assume full responsibility for any action you take based on the report.

8. Limitation of liability

To the maximum extent permitted by applicable law, the Company's total liability arising out of or relating to these Terms, the Site, or the Service — regardless of legal theory — is limited to the amount you paid for the Service. The Company is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, crops, plants, or property value, even if advised of the possibility of such damages. Some jurisdictions do not allow these limitations; in those jurisdictions, the limitations apply to the maximum extent permitted by law.

9. Disclaimer of warranties

The Service is provided "as is" and "as available." The Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, except to the extent such disclaimers are not permitted by applicable law.

10. Intellectual property

The Site, the report templates, and the underlying analytical methods are owned by the Company or its licensors and are protected by U.S. and international intellectual-property law. You may use your own report for your own non-commercial purposes. You may not copy, modify, distribute, sell, or reverse-engineer any portion of the Site or the Service except as expressly permitted.

11. User accounts and communications

By providing your email address, you consent to receive transactional emails about your order. If you join a product waitlist, you consent to receive email about that product's availability. Marketing emails are opt-in and may be unsubscribed at any time using the link in any marketing email.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The parties agree that any dispute will be resolved exclusively in the state or federal courts located in the State of Delaware, and each party consents to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and post the updated Terms on the Site with a new "Last updated" date. Continued use of the Site or Service after the effective date of the updated Terms means you accept the change.

14. Termination

We may suspend or terminate your access to the Site or Service if you violate these Terms or use the Service in a way that creates risk for the Company or other customers. The sections of these Terms that by their nature should survive termination (including Sections 7, 8, 9, 10, and 12) will survive.

15. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and Refund & Shipping Policy, are the entire agreement between you and the Company regarding the Site and Service and supersede any prior agreements on the same subject.
